Meeting Began: Mayor Frank Etro called the meeting to order at 8:09 PM. The Pledge of Allegiance followed.

Vice Mayor Graham asked that Jennifer Jenkins prepare a presentation to give to the public at the February 16^th’s meeting.

Mayor Etro opened the meeting by asking Council Member Ramsey to bring Council up to date on the progress on 7 Main Street application from the Land Use Committee’s perspective. Council Member Ramsey said that the Land Use Committee has had the applicant’s proffers for approximately a month, they have met four times and the proffers have changed, with more illustrative being added. There is more detail to both storm water management and the parking lot section of the proffers. The Land Use Committee will now be forwarding the proffers on to Council with no recommendation because there are still a couple of issues to be worked out.

Council Member Ramsey suggested that Council go through the proffers line by line and discuss any concerns. The following items were discussed in depth, with Council Members asking questions of the applicant and discussing items they felt were an issue. These matters, which are part of the proffers, are to be altered or further consideration given by applicant, by the next regular Town Council Meeting on February 16^th.

• February 9^th version, added Metes & Bounds to the first paragraph
• Exhibit “B” will be revised striking the “6’ high privacy fence” and refer to “storm water management to the rear of property” instead of in a specific area
• Concept Plan- Added that “no more than 3700 square feet will be at or above grade” on fourth paragraph.
• Use- the words “at or above grade” to be added and 50% changed to “a minimum of 60% of the first floor of the building shall be maintained for uses set forth in Paragraph 1….”
• Transportation and Parking- the boundary is to be define with some type of detail, this will be subject to approval at the site plan process.
• Transportation and Parking- 4^th paragraph to be reworked by both attorneys during the week and agreed upon before next Town Council meeting a concept and direction was agreed to allowing the potential for a shared parking lot in the future on either side with out a financial burden to this property owner.
• Drainage- language will be added to allow the town to relocate underground utilities necessitated by drainage improvements. The drainage paragraphs will be numbered.
• Vegetative swale detail will replace “Exhibit C” and concept plan will change to be more flexible for the engineer, but will be subject to final approval by Town at the site plan process
• Landscaping and Buffers- will add “entitled landscape plan, dated February 9^th, 2006”
• Lighting- remove “on the property” in the second sentence
• Development and Design Guidelines- strike “applicant will not use vinyl siding” and adding on “Exhibit F” entitled front elevation, dated February 9^th, 2006
• Signage- changing sentence to read “applicant will design and install all signage”
• Landscaping plan- put back the delineation of patio site and add the staggering rear line buffer of Laurel trees

Council Member Ramsey told the applicant that the proffer statement for “7 Main Street” would be an action item on next weeks Town Council Meeting. Mr. Ramsey asked that the Town Attorney stay in contact with Deborah Welsh the Applicant’s Attorney to ensure all changes to the proffer statement are complete before that meeting.
